Sophia School Corporation Code for Preventing Harassment

Sophia School Corporation Code for Preventing Harassment

(Purpose)

Article 1

The purpose of this Code is to prevent harassment in order to ensure that education, research, studies, student life and work are conducted in a fair and safe environment, as Sophia School Corporation (hereinafter referred to as the Corporation) respects the individuality of all its members, and recognizes that sexual harassment is an infringement of human rights and may lead to sexual discrimination. At the same time, the Code will act to provide assistance to the victims of harassment.

(Definition)

Article 2

Harassment in this Code refers to behaviors that fall under one of the following categories:

(1) Sexual Harassment

Sexual harassment refers to any unwelcome conduct of a sexual nature and physical behavior or verbal expressions arising from a sexually discriminative disposition, which falls into one of the following categories:

(1a) (Quid pro quo sexual harassment)

Verbal or physical conduct of a sexual nature committed by a person in a position of authority in relationships related to education, research, work, or student life where the victim may benefit if he/she accedes or may be harmed if he/she does not accede.

(1b) (Environmental sexual harassment)

Verbal or physical conduct of a sexual nature that causes feelings of discomfort and creates a hostile or offensive educational or working environment.

(2) Academic Harassment

Academic harassment is discrimination committed by persons with authority or in higher position such as senior professors abusing their power against junior faculty members or students through inappropriate behavior in educational and research environment.

(3) Power Harassment

Power harassment is committed by faculty or staff members abusing their power against other members through inappropriate behavior at work.

(Scope)

Article 3

The Code encompasses any harassment which has taken place among faculty and staff of the Corporation (regardless of job classification) and students of schools established by the Corporation, exchange students, non-degree students, auditors, students of Sophia University and Sophia Junior College Community College, staff of attached institutes and centers, visiting lecturers, visiting researchers, joint researchers, special researchers, exchange professors, and so forth (hereinafter referred to as teachers and students), both on and off campus, and during or outside of service hours, as long as the harassment is related to the Corporation.

If the incident of harassment is in any way related to the Corporation, it is not relevant when and where the harassment took place, whether on or outside the campus, during or after classes, during or after working hours.

2. For harassment committed against faculty, staff or students by any person outside the Corporation, efforts will be made to take appropriate measures according to this Code.

(Prohibition and Awareness)

Article 4

The Corporation will not permit any harassment under any circumstances. It will promote activities to increase awareness of harassment among faculty, staff and students.

(Guidelines)

Article 5

The Corporation sets forth Harassment Guidelines to achieve the purposes stipulated in this Code. The Guidelines shall be made known to all faculty, staff and students of the schools established by the Corporation.

(Responsibilities of the Chancellor and the Presidents)

Article 6

The Chancellor and the Presidents of schools established by the Corporation shall observe this Code in order to prevent and eliminate any harassment that inhibits the activities of education, research, studies, student life and work. If there is a case of harassment, they shall take prompt and appropriate measures in accordance with the Code.

(Responsibilities of All Faculty, Staff and Students)

Article 7

All faculty, staff and students of the schools established by the Corporation must observe the Harassment Codes, and must take heed not to commit acts of harassment.

2. To maintain a comfortable working environment, those responsible for supervising the faculty and staff must make efforts to prevent and eliminate harassment through instructions given in daily work. If there is a case of harassment, they shall take prompt and appropriate measures in accordance with the Code.

(Prevention Committee)

Article 8

To discuss the prevention of harassment, investigation of damage, assistance to the victim, matters concerning Consultants, and other related matters, the Corporation shall establish under the Chancellor a Harassment Prevention Committee (hereinafter referred to as the Prevention Committee)

2. Regulations pertaining to the Prevention Committee shall be stipulated separately.

(Consultants)

Article 9

The Corporation shall establish Consultants to consult about harassment.

2. Regulations pertaining to Consultants shall be stipulated separately.

(Protection of Privacy and Confidentiality)

Article 10

The members of the Prevention Committee, Consultants and other related faculty and staff involved in resolving individual cases of harassment shall protect the privacy and human rights of the related parties and shall keep all related information strictly confidential.

(Prohibition of Disadvantage)

Article 11

Faculty, staff and students shall not be put at a disadvantage for being involved in reporting harassment, for cooperating in the investigation of harassment, or for any other matters related to harassment.

(Prohibition of False Reports and Testimony)

Article 12

False reports and testimony relating in any way to harassment shall be prohibited. If such a case occurs, the Corporation shall consider punishment against either the person making a false report or the person giving false testimony, and will promptly make efforts to restore the reputations those who have been falsely implicated.

(Revising or Abolishing the Code)

Article 13

The Code shall be revised or abolished in accordance with procedures set forth by the Corporation, after deliberation by the Prevention Committee.

Supplement

1. This Code will be enacted as of April 1, 2003.

2. This Code and the Guidelines on Harassment will be reviewed after one year.

3. This revised Code will be enacted as of April 1, 2005.

4. This revised Code will be enacted as of April 1, 2010.
